Acceptable Use Policy
This Acceptable Use Policy is part of the Clarly Terms of Service (https://clarly.esap.ai/legal/terms). It applies to you, your team and anyone who uses Clarly through your account, and to every message, reply and setting you send or configure through Clarly.
1. Messaging platform rules
You must follow the rules of every channel you connect, including the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, the Meta Platform Terms and the Meta Community Standards. In particular you must:
- get a customer's opt-in before you start a conversation with them on WhatsApp, and keep a record of it;
- honour every opt-out at once, including a customer replying "STOP" or "STOP MARKETING";
- outside the customer-service window Meta allows, contact customers only with message templates Meta has approved;
- keep your business profile, catalogue and templates accurate and not misleading.
2. Prohibited goods, services and content
You must not use Clarly to sell, promote or send:
- anything illegal in Saudi Arabia or where your customers are, or prohibited by the WhatsApp Commerce Policy, such as drugs, prescription medicines, weapons, tobacco, alcohol, gambling, adult content, counterfeit goods and live animals;
- false, misleading or unsupported claims, including health or medical claims about products;
- content that is hateful, violent, harassing or sexually explicit, or that exploits children;
- malware, phishing links or anything designed to deceive people into giving information or money.
3. Prohibited conduct
You must not:
- send spam, unsolicited bulk messages, or messages to numbers you bought or scraped;
- impersonate a real person, business or authority, or hide who you are from Meta;
- ask customers to send card numbers, passwords or one-time codes in chat;
- process personal or sensitive data you have no legal basis to process;
- use Clarly to make decisions about credit, insurance, employment or housing, or any other decision with legal or similarly significant effects on a person.
4. Automated replies
You are responsible for the instructions, knowledge, prices and limits you give Clarly. You must not configure or instruct it to give medical diagnoses or medical, medication, treatment, legal or financial advice; to state prices, stock, terms or policies you know to be wrong; or to pressure customers in a misleading way. Keep a person available to answer customers who ask for one.
5. Security and fair use
You must not:
- probe, scan or test the security of Clarly, or reverse-engineer it, except with our written permission;
- bypass usage limits, access controls or the separation between workspaces;
- overload the service, or run bots or automated scripts against it;
- share login details, resell the service, or let anyone outside your business use your account, except as we agree in writing.
6. Enforcement
If we reasonably believe this policy has been breached, we may remove or block content, pause a channel or an automated reply, or suspend or terminate your access under the Terms. Where the law or Meta's terms require, we report the breach to Meta or to the competent authorities. Meta can also restrict or ban your accounts under its own rules.
7. Reporting abuse
To report misuse of Clarly, write to privacy@clarly.esap.ai with the business name, the channel or number used, and what happened. We review every report.
